OFFICE MEMORANDUM

Subject:- Special concessions/facilities to Central Government Employees working in Kashmir Valley in attached/subordinate offices or PSUs falling under the control of Central Government.

The undersigned is directed to refer to this Department’s O.M. No. 18016/3/20l0-Estt.(L) dated 27th January, 2011 on the subject mentioned above and to state that it has been decided to extend the package of concessions/incentives to Central Government employees working in Kashmir Valley for a further period of one year w;e.f. 01.01.2012 upto 3 1.12.2012. The revised package of incentives is as per annexure.

2. The package of incentives is uniformly applicable to all Ministries/Departments and PSUs under the Government of India and they should ensure strict adherence to the rates prescribed in the package. The concerned Ministry/Department may ensure implementation and monitoring of the package in conformity with the approved package, and therefore, all Court cases in which verdicts are given contrary to the package would have to be contested by the Ministries/Departments concerned.

House Building Advance – Enhancement of Cost Ceiling of House Building Advance from Rs.15 to Rs.25 lakhs in Tamil Nadu

Tamil Nadu Government has decided to increase the Cost ceiling of House Building Advance to its employees from 15 lakhs to 25 lakhs, due to escalation in the cost of land and building materials.

An important abstract order issued from Finance Department of Tamil Nadu on 20.6.2012 regarding enhancement of Cost Ceiling of Housing Loan to State Government employees and officers. The Government Order says,  ‘the ceiling on House Building Advance to the Government Servants was lastly revised in the year 2009.

At this distance of time, considering the escalation in the cost of land and building materiel, the Hon’ble Minister for Finance, in the Budget Speech for the year 2012-2013, has announced enhancement of the present House Building Advance ceiling from Rs.15 lakhs to  Rs.25 lakhs to Government Employees. Further, the Government have also considered enhancement of House Building Advance ceiling from Rs.25 lakhs to Rs.40 lakhs to All India Service Officers. The Government after careful examination have decided to enhance the existing maximum ceiling of House Building Advance as above

Subject: Rotational Transfer of Section Officers with more than 16 years of service in the same Ministry/Department.

The undersigned is directed to refer to this Department’s Order of even No. dated 10 May, 2012 by which the Section Officers, who have put in more than 16 years service in a particular Cadre Unit, have been transferred and posted to other Cadre Units

2. All the Cadre Units were requested to relieve the officers concerned immediately. However, a number of Section Officers included in the said order have not been relieved by the Cadre Units concerned.

3. As per the CSS Rules, 2009 amended vide notification dated September,2010, it shall be the duty of the Cadre Units concerned to relieve the officer concerned within 45 days on receipt of the transfer order or further such period, if any, allowed by the Department of Personnel & Training (DOP&T) for reasons to be recorded in writing. If an officer is not relieved within 45 days or such further period as referred to above, the officer shall be ‘deemed’ to have been relieved by the cadre unit in which he is working and thereafter the officer shall not be entitled to draw salary and allowances for the period of such overstay in the cadre unit from where the officer was transferred.

4. The period of 45 days as envisaged in the notification will be over on 24th June, 2012 Therefore, the Cadre Units concerned are requested to relieve the remaining Section Officers, whose names appear in the said order, immediately. if not already done, latest by 24”' June, 2012. Section Officers included in the list, who do not join in the new Cadre Unit by the end of this month, will not be entitled to draw the salary and allowances from .24th June, 2012 onwards from the Cadre Unit

Subject: Modified Assured Career Progression Scheme for the Central Government  Civilian Employees — Clarification regarding grant of benefits of MACPS to  officers who have later on inducted into Organized Group A Services -

In terms of clarification given on point of doubt no. 2 of Annexure of this Department’s O.M. dated 09.09.2010, no benefits under the MACPS would be applicable to Group A officers of Organised Group A Services, as the officer under organized Group  ’A’ Services have already been allowed parity of two years on non-functional basis with  the officers of the Indian Administrative Service (IAS). In this regard, this Department is in  receipt of a number of references from various Departments in respect of officers who are  deprived of the benefits of MACPS due to their induction into the organised Group A  Services at a later stage of their service.

2. The issue has been considered by this Department in consultation with Department  of Expenditure. It has been decided to allow grant of financial up-gradations under  MACPS with effect from the due date to those officers who are inducted to the Organized Group ‘A’ Services when they are nearing retirement subject to the condition that only at  the time of retirement an evaluation of up gradations/ promotions earned by the officer  would be made. In case such officers have already attained three financial upgradations

under MACP Scheme, they shall not be entitled for NFU to the same grade from a later date.

The undersigned is directed to refer to this Department’s O.M. of even No. dated 18th June, 2010 on the subject mentioned above and to say that the relaxation for LTC travel to visit J & K under CCS (LTC) Rules, 1988 is extended for a further period of two years w.e.f. 18th June, 2012 subject to the following conditions:

(a) Travel by Air to continue to be in Economy Class only, irrespective of the entitlement of the officer.

(b) The condition that air tickets can be purchased either directly from the Airlines (booking counters/website) or through authorized agents only viz., M/s Balmer Lawrie and Co. Ltd., or M/s Ashok Travels and Tours Ltd./IRCTC (to the extent IRCTC is authorized as per D0PT’s O.M.No. 31011 /612002-Estt.(A) dated 02.12.2009), would necessarily apply.

(C) All other conditions prescribed in this Department’s O.M. dated 1 8.6.2010, read with O.M. dated 05.8.2010 and 25.8.2011 would continue to apply.

Subject: Recognition of P.V.S. Hospital, Chitradurga (Karnataka) for treatment of Central Government employees under CS(MA) Rules, 1944. 

      The undersigned is directed to say that with a view to provide better medical services to the Central Government employees and their family members at Chitradurga (Karnataka), it has been decided to renew the recognition of P.V.S. Hospital, Chitradurga (Karnataka) under Central Services (Medical Attendance) Rules, 1944. 

2.  The   Schedule   of  charges   for   the   treatment   of  Central   Government Employees and the member of their family under the CS(MA) Rules, 1944, will be the rates fixed for CGHS, Bangalore. The approved rates are available on the website of  CGHS (www.mohfw.nic.in/cghs.html) and may be downloaded/ printed.

3. The undersigned is further directed to clarify as under:-

(a) "Package Rate" shall mean and include lump sum cost of in-patient treatment/day care/diagnostic procedure for which a CGHS beneficiary has been permitted by the competent authority or for treatment under emergency from the time of admission to the time of discharge, including (but not limited to)-(i) Registration charges, (ii) Admission charges, (iii) Accommodation charges including patient's diet, (iv) Operation charges, (v) Injection charges, (vi) Dressing charges, (vii) Doctor/consultant visit charges, (viii)  ICU/ICCU charges, (ix) Monitoring charges, (x) Transfusion charges, (xi) Anesthesia charges, (xii) Operation theatre charges, (xiii) Procedural charges / Surgeon's fee, (xiv) Cost of surgical disposables and all sundries used during hospitalization, (xv) Cost of medicines, (xvi) Related routine and essential investigations, (xvii) Physiotherapy charges etc, (xviii) Nursing care and charges for its services.

SC refuses to stay AP High Court order on quota issue

The apex court expressed its "unhappiness" that the Centre was blaming the High Court when it had itself failed to produce documents to support its case.

A Bench of justices K S Radhakrishnan and J S Khehar was critical of the Ministry of Human Resource Development rushing to the apex court with the appeal against the May 28 order of the High Court without documents to justify the policy of carving out 4.5 per cent sub-quota within the 27 per cent OBC reservation.

Without issuing any notice, the bench asked Attorney General G E Vahanvati to produce before it the supporting documents on the issue by tomorrow and posted the matter for hearing on Wednesday.

The bench said it cannot stay the high court order "unless the government produces material to show a detailed exercise was undertaken to carve out the sub-quota."

The Attorney General started submissions by taking "blame on his shoulders" for the outcome of sub-quota policy in the high court by saying that the "argument was not the most brilliant".

He sought some protection in view of the ongoing counselling for IITs for which 325 candidates have qualified for it under the 4.5 per cent sub quota and their career and future could be jeopardised if they are not allowed to appear for the counselling.

When Vahanvati said there was need for some protection in view of the ongoing counselling for IITs, the bench said "we will not order stay".

"First of all you have not produced any documents in the high court. We would have been happy, if you had done so," the bench said.

The bench wanted to know from the senior most law officer as to what was the basis and how did the government determine 4.5 percent sub-quota for minorities.

When the Attorney General sought to point out errors in the high court order, the bench said it was natural for the high court to ask questions on which the Centre was complaining.

The bench, which was not in agreement with Vahanvati that the "High Court has gone completely wrong," said "when the December 22, 2011 Office Memorandum (OM)(on 4.5 per cent sub quota) reflected nothing, the High Court will ask questions".

"Without placing documents how can you find fault with the high court (order)," the bench said adding that "where is the material and the High Court says nothing is produced."

When Vahanvati said the High Court also missed the 1993 notification on the caste identification, the bench wanted to know whether it was placed before it or not.

The Attorney General said he was told that a reference was made about it but not placed.

At this the bench said, "how can you then point out error in the High Court judgement."

The bench also questioned the government saying "how can you (Centre) break up the 27 percent OBC quota."

"It is a complex matter, you are carving out sub-quota from 27 percent quota. Tomorrow you will carve out further quota," it said.
