Subject :  Grant of Honorarium to Inquiry Officers (IO)/Presenting Officers (PO) - Consolidated instructions regarding.

The undersigned is directed to say that the Department of Personnel and Training have issued instructions vide NO 1344/99-AVD-I dated 29th June 2001 and 7th April 2003  on the subject of honorarium to the Inquiry Officers and Presenting Officers covering the aspects of rates of honorarium, appointment of retired officers as Inquiry Officer, terms and conditions for payment of honorarium etc from time to time. The rates of honorarium payable to IO/PO were last revised vide this Department's OM no 142/20/2008-AVD-I dated 27th July 2009. [copy attached]. 

2. A Committee of Experts set up to review the procedure of Disciplinary Nigilance inquiries and to recommend measures for their expeditious disposal under the chairmanship of P.C Hota, former Chairman of UPSC in May 2010 had made a series of recommendations in July 2010 including the rates of honorarium. The detailed recommendation of the expert committee is available on the website of this Department. It can be accessed through the Link.

The Reconunendations of the Committee on the proposed increases in Honorarium relating to IO/PO are contained in paras 37, 42-44 of the report of the Committee. 

3. The recommendations of the Expert Committee on the aspect of revision of rates of honorarium along with some other related measures were examined in the Department and was placed before the Group of Ministers on Corruption, set up for examining measures, including legislative and administrative, to tackle corruption and improve transparency. The Group of Ministers while considering the Terms of Reference also considered the recommendations of the HOTA Committee and recommended that the remuneration of the 
IOs and POs may be fixed, keeping in mind the recommendations of the HOTA Committee. These recommendations of the GOM have been accepted by the Government. 

4. It has therefore been decided to revise the existing rates of honorarium payable to IO/PO in line with the recommendations of the Expert Committee. The revised rates of Honorarium and other allowances payable to IO both serving and retired officers and PO(serving) and the terms and conditions governing the same is indicated in Annexure -1 to this OM. The rates of Honorarium stated therein are ceilings and the concerned 
ministry/department where the misconduct was committed may decide the exact quantum of honorarium to be paid keeping in mind the volume of work involved in specific cases and the terms and Conditions indicated in the Annexure -1. 

5. The revised structure of rates of honorarium and allowances as indicated in Annexure-I are intended to be made applicable to Departmental Proceedings including inquiry proceedings undertaken by the committee on Sexual Harassment, by Ministries /Department in respect of officials /officers serving under different cadres of services under their administrative control. However, in case a cadre of a service or organisations such as 
autonomous bodies have a separate set of rules and instructions for regulating honorarium to IO/PO in existence they may choose to continue with their own set of instructions. Fully or partially funded autonomous bodies may retain their own provisions so long as they are not more beneficial than what has been proposed in this OM. 

6. This orders will take effect from tie date of issue of this OM and will also apply to all inquiries in progress. 

7. The services of serving officers may be used as IO and PO to the extent possible in the conduct of departmental inquiries. However, Central Vigilance Commission has been requested to create and maintain a panel of retired officers/officials willing to serve as IO for conducting departmental inquiries and for this purpose also design a procedure for inviting applications from the retired Government Servants to be followed by the Ministries and Departments. Till such time such a panel of retired officers become available from CVC, the concerned ministries /departments may, where it is not possible to use the services of a 
serving officer as Inquiry Officer for conducting departmental inquiries, use the services of officers who have retired from Ministries/Departments, for conducting such departmental inquiries. 

8. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their UO no.14(4)/2009-E-II(B) dated 26.3.2012 and 5.6.2012.

Review of three years time limit for making compassionate appointment.

Subject : Review of three years time limit for making compassionate appointment.

The primary objective of scheme for compassionate appointment circulated vide O.M. No. 14014/6/94-Estt(D) dated 09.10.1998 is to provide immediate assistance to relieve the dependent family of the deceased or medically retired Government servant from financial destitution i.e. penurious condition. The Hon’ble Supreme Court in its judgment dated 05.04.2011 in Civil Appeal No. 2206 of 2006 filed by Local Administration Department vs. M. Selvanayagam ® Kumaravelu has observed that "an appointment made many years after the death of the employee or without due consideration of the financial resources available to his/her dependents and the financial deprivation caused to the dependents as a result of his death, simply because the claimant happened to be one of the dependents of the deceased employee would be directly in conflict with Articles 14 & 16 of the Constitution and hence, quite bad and illegal. In dealing with cases of compassionate appointment, it is imperative to keep this vital aspect in mind”.

2. This Department’s O.M. No. 14014/6/1994-Esst.(D) dated 09.10.1998 provided that Ministries/Departments can consider requests for compassionate appointment even where the death or retirement on medical grounds of a Government servant took place long back, say five years or so. While considering such belated requests it was, however, to be kept in view that the concept of compassionate appointment is largely related to the need for immediate assistance to the family of the Government servant in order to relieve it from economic distress. The very fact that the family has been able to manage somehow all these years should normally be taken as adequate proof that the family had some dependable means of subsistence. Therefore, examination of such cases call for a great deal of circumspection. The decision to make appointment on compassionate grounds in such cases was to be taken only at the level of the Secretary of the Department/Ministry concerned.

3. Subsequently vide this Department’s O.M. No.14014/19/2002-Estt.(D) dated 5th May, 2003 a time limit of three years time was prescribed for considering cases of compassionate appointment. Keeping in view the Hon’ble High Court Allahabad judgment dated 07.05.2010 in Civil Misc. Writ Petition No. 13102 of 2010, the issue has been re-examined in consultation with Ministry of Law. It has been decided to withdraw the instructions contained in the O.M. dated 05.05.2003.

4. The cases of compassionate appointment may be regulated in terms of instructions issued vide O.M. dated 09.10.1998 as amended from time to time. The onus of examining the penurious condition of the dependent family will rest with the authority making compassionate appointment.

Subject: Promotion of LDC as UDC of Central Secretariat Clerical Service (CSCS) on ad-hoc basis-Continuance of Ad-hoc appointments regarding.

The undersigned is directed to refer to this Department’s 0M. No. 3/2/2010-CS.II dated 28th December, 2011 whereby cadre units were permitted to continue the ad-hoc appointments in the UD Grade of CSCS up to 30.06.2012 and to say that the continuation of the ad-hoc appointments in the U.D grade made by the cadre units has been reviewed in this Department. Since availability of regular UDCs through normal modes of recruitment prescribed under the CSCS Rules may take some more time, it has been decided that the period of ad-hoc appointment of those UDCs,who already have been working as UDC on ad-hoc basis in the UD Grade of CSCS may be extended up to 315t December, 2012 or till regular UDCs become available, whichever is earlier.

2. Other terms and conditions mentioned in this Department’s O.M. No. 3/6/2004-CS.II dated 28.2.2005 will remain unchanged.

Subject:- Special concessions/facilities to Central Government Employees working in Kashmir Valley in attached/subordinate offices or PSUs falling under the control of Central Government.

The undersigned is directed to refer to this Department’s O.M. No. 18016/3/20l0-Estt.(L) dated 27th January, 2011 on the subject mentioned above and to state that it has been decided to extend the package of concessions/incentives to Central Government employees working in Kashmir Valley for a further period of one year w;e.f. 01.01.2012 upto 3 1.12.2012. The revised package of incentives is as per annexure.

2. The package of incentives is uniformly applicable to all Ministries/Departments and PSUs under the Government of India and they should ensure strict adherence to the rates prescribed in the package. The concerned Ministry/Department may ensure implementation and monitoring of the package in conformity with the approved package, and therefore, all Court cases in which verdicts are given contrary to the package would have to be contested by the Ministries/Departments concerned.

Subject: Rotational Transfer of Section Officers with more than 16 years of service in the same Ministry/Department.

The undersigned is directed to refer to this Department’s Order of even No. dated 10 May, 2012 by which the Section Officers, who have put in more than 16 years service in a particular Cadre Unit, have been transferred and posted to other Cadre Units

2. All the Cadre Units were requested to relieve the officers concerned immediately. However, a number of Section Officers included in the said order have not been relieved by the Cadre Units concerned.

3. As per the CSS Rules, 2009 amended vide notification dated September,2010, it shall be the duty of the Cadre Units concerned to relieve the officer concerned within 45 days on receipt of the transfer order or further such period, if any, allowed by the Department of Personnel & Training (DOP&T) for reasons to be recorded in writing. If an officer is not relieved within 45 days or such further period as referred to above, the officer shall be ‘deemed’ to have been relieved by the cadre unit in which he is working and thereafter the officer shall not be entitled to draw salary and allowances for the period of such overstay in the cadre unit from where the officer was transferred.

4. The period of 45 days as envisaged in the notification will be over on 24th June, 2012 Therefore, the Cadre Units concerned are requested to relieve the remaining Section Officers, whose names appear in the said order, immediately. if not already done, latest by 24”' June, 2012. Section Officers included in the list, who do not join in the new Cadre Unit by the end of this month, will not be entitled to draw the salary and allowances from .24th June, 2012 onwards from the Cadre Unit

Clarification regarding grant of benefits of MACPS to officers who have later on inducted into Organized Group A Services

Subject: Modified Assured Career Progression Scheme for the Central Government  Civilian Employees — Clarification regarding grant of benefits of MACPS to  officers who have later on inducted into Organized Group A Services -

In terms of clarification given on point of doubt no. 2 of Annexure of this Department’s O.M. dated 09.09.2010, no benefits under the MACPS would be applicable to Group A officers of Organised Group A Services, as the officer under organized Group  ’A’ Services have already been allowed parity of two years on non-functional basis with  the officers of the Indian Administrative Service (IAS). In this regard, this Department is in  receipt of a number of references from various Departments in respect of officers who are  deprived of the benefits of MACPS due to their induction into the organised Group A  Services at a later stage of their service.

2. The issue has been considered by this Department in consultation with Department  of Expenditure. It has been decided to allow grant of financial up-gradations under  MACPS with effect from the due date to those officers who are inducted to the Organized Group ‘A’ Services when they are nearing retirement subject to the condition that only at  the time of retirement an evaluation of up gradations/ promotions earned by the officer  would be made. In case such officers have already attained three financial upgradations
under MACP Scheme, they shall not be entitled for NFU to the same grade from a later date.

Subject: Rotational Transfer of Assistant with more than 16 years of service in the same Ministry/Department - reg.

The undersigned is directed to refer to this Department’s OM of even number dated 11th  April 2012 whereby Cadre Units were requested to furnish information/preference of posting of Assistants who have completed more than 16 years of service in any capacity in a particular Ministry/Department (excluding those who are due for superannuation within two years as on 01.0 1.2012).

2. It is noticed that a number of cadre units have not furnished the requisite information so far. The defaulting Cadre Units addressed below are therefore, requested to furnish information/preference of posting of Assistants who have completed more than 16 years of service in any
capacity in a particular Ministry/Department (excluding those who are due for superannuation within two years as on 01.01.2012) to this Division immediately.

3. The Cadre Units who have earlier furnished only the list of Assistants covered under RTP are requested to obtain the preference for Posting in the proforma (copy enclosed) and furnish the same to this Department immediately.

Attention is invited to modified FCS for Scientists based on 6 th  CPC recommendations issued in this Department's OM of even number dated 10.9.2010. In pursuance of amendment to Central Civil Services (Revised Pay) Rules,2008 vide Ministry of Finance (Department of Expenditure) notification dated 16th  July, 2009, the entries "grade pay of Rs.12000 or lower" in Para (i) of the scheme shall be substituted with "HAG scale of Rs.67000-(annual increment @ 3%)-79000"
2.  Promotion of Scientists in Department of Space, Atomic Energy and DRDO would be in accordance with the provisions under the Merit Promotion Schemes in these Departments.

Subject:- Introduction of Annual Medical Examination for the Group ‘A’ officers of Central Civil Services of age 40 years and above.

The undersigned is directed to say that a scheme of Annual Medical Check-up is already operating in respect of All India Service officers. This Department had taken up the issue of covering Group A’ officers of Central Civil Services/posts for Annual Medical Check-up in consultation with the Ministry of Health and Family Welfare and the Ministry of Finance (Department of Expenditure). It has now been decided that Group ‘A’ officers of Central Civil Services/Posts of and above the age of 40 years will be covered by the Annual Medical Check- up scheme. The following package rates for the above purpose have been approved:-

(i) Annual Medical Examination of Men officers- Rs. 2000/-
(Rupees Two Thousand only)
(ii) Annual Medical Examination of Women officers- Rs, 2200/-
(Rupees Two Thousand and Two Hundred only)

2. The regime of medical tests for the above purpose will be as given in the ANNEXURE-I.

Subject : Fixation of ‘range of seniority’ (zone of promotion) for promotion of Stenographers Grade ‘D’ to Personal Asaistant(PA) Grade of CSSS for the Select List Year- 2010—reg.

Reference is invited to this Department’s O.M. of even  number dated 16th February, 2012 on the subject mentioned  above vide which all the cadre units were requested to place the cases of all eligible Stenographers Grade ‘D’ who were covered within the prescribed ‘range of seniority’ and who had not yet been included in the Select List of PAs of CSSS before the DPC to  assess their suitability or otherwise for promotion to the PA grade of CSSS. Cadre Units were also requested to furnish the  recommendations of the DPC alongwith vigilance clearance in  respect of all the eligible officers who are working in their cadre units including those who had been transferred to their cadre units from other cadre units on their ad-hoc promotion to PA grade of CSSS.

2. The requisite information is still awaited from all the Cadre Units. The Cadre Units are, therefore, requested to expedite the  necessary information to enable this Department to finalize the Select List of PA grade for the year —2010.

A Group Training Course in Material and Child Health (A) In Japan

TRAINING CIRCULAR

Subject: A Group Training Course in Material and Child Health (A) In Japan.

The undersigned is directed to state that the Japan International Cooperation Agency [JICA] under the Technical Cooperation of the Government of Japan has invited applications for the above programme to be held from April-December 2012 out of which the core phase would be held in Japan from 8th May to 23rd June, 2012. The details of the programme and the application form may be drawn from Ministry of Personnel, Public Grievances and Pensions website (persmin.nic.in).

2. The Program aims to contribute to improve reduction of child mortality, improvement of material health, Material and Child health indices (ex- child mortality rate, material mortality ratio) in developing countries so that skills and knowledge of nursing staff shall be improved and better material and child health care service with meeting local people’s health needs in participants’ region will be provided.

3. The candidate should be a head nurse or equivalent in charge of nurse and midwife training in hospital, or be a professor/lecturer or equivalent in charge of nurse or midwife training in university or equivalent (medical doctors are not eligible); having experience of more than five (5) years in the field of Material and child health as a nurse or midwife; be a certified nurse or midwife; be proficient in written and spoken English; be in good health, not be serving on military and between 25 years and 45 years of age.

4. The course covers the cost of a round-trip air ticket between an international airport designated by JICA; travel insurance from the time of arrival in Japan to departure from Japan; allowances for (accommodation, living expenses, outfit and shipping); expenses for JICA study tours and free medical care for participants who may fall ill after reaching Japan [costs relating to pre-existing illness, pregnancy, or dental treatment is not included].

5. It is requested that the nomination of the suitable candidates may please be forwarded to this Department in accordance with the eligibility criteria.

6. The nomination details should be submitted in the JICA’s prescribed proformas duly authenticated by the Department concerned along with the country report.

7. The applications should reach this Department through the Administrative Ministry/State Government not later than 1st March, 2012. Nominations received after the prescribed date will not be considered.

NO.12011/03/2008-Estt.(Allowance) dated 2nd September,2008, and subsequent clarifications issued from time to time on the subject cited above, and to state that various Ministries/Departments have been seeking clarifications on various aspects of the Children Education Allowance/Hostel Subsidy. The doubts raised by various authorities are clarified as under:

What constitute “Fee” as per para l (e) of the O.M. dated 2/9/2008 and whether fee paid for extra-curricular activities to some other institute and reimbursement of, school bags, pens/pencils, etc., Can be allowed? Is there any item-wise ceiling?
“Fee” shall mean fee paid to the school in which the child is studying, directly by the parents/ guardian for the items mentioned in para l (e) of the O.M. dated 2/9/2008. Reimbursement of school bags, pens/pencils, etc., may not be allowed. There is no item-wise ceiling.

Whether reimbursement can be allowed in case the original receipts are misplaced and duplicate receipts are produced by the Government servant?
In case of misplacement of receipts given by the school/institution towards charges received from the parents/guardian, reimbursement may be allowed if the Government servant produces a duplicate receipt, duly authenticated by the school authorities. Receipts from private parties, other than the school, if misplaced shall not be entertained, even if a duplicate receipt is produced. Original receipts from school authorities need not be attested/countersigned/rubber stamped by the school authorities.

Whether a Government servant is allowed to get 50% of the total amount subject to the overall annual ceiling in the first quarter and the remaining amount in third and or fourth quarter?
Reimbursement of 50% of the entitled amount for the academic year could be allowed in the first and/or second quarter and the remaining amount could be reimbursed in the third and/or fourth quarter. However the entitled amount can be reimbursed in the last quarter.
4.
It is provided that whenever the DA increases by 50% the CEA will increase by 25%. What shall be the date of effect of such enhancement?
Any enhancement in the ceiling of reimbursement per annum due to increase in DA by 50%,shall be applicable on pro-data basis from the date of increase in DA, subject to actual expenditure during the quarte

Clarification regarding regulation of payment of employer’s share of contribution to the Contributory Provident Fund during the period of reverse deputation

Subject:- Clarification regarding regulation of payment of employer’s share of contribution to the Contributory Provident Fund during the period of reverse deputation.

The undersigned is directed to refer to this Department’s 0.M,No. 6/8/2009.Estt.(Pay II) dated 17th June, 2010 vide which instructions were issued for regulating the terms and conditions of pay, Deputation (duty) allowance etc. on transfer on deputation/foreign service of Central Government employees to ex-cadre posts under the Central Government/State Governments/Public Sector Undertakings/Autonomous 
Bodies, Universities/UT Administration, Local Bodies etc. and vice-versa,


2. As per para 7.7 (ii) of the above cited 0M., in the case of deputation on foreign service terms to PSUs etc., leave salary contribution and pension contribution/CPF contribution are required to be paid either by the employee himself or by the borrowing organisation to the Central Govt.


3. The issue of payment of employer’s share of Contribution to the Contributory Provident Fund in case of reverse deputation has been considered in this Department. It is clarified that in case of reverse deputation the employer’s share of Contributory Provident Fund for the period on deputation to the Central Government will be borne either by the employee himself or the borrowing organization i.e Central 
Government depending on the terms of deputation. A clear mention of the stipulation on whether the Central Government or the employee would bear the liability may be made in the terms of deputation.

Fixation of Pay of All India Services on the grant of proforma promotion

Sub: Fixation of Pay of All India Services on the grant of proforma promotion - regarding.

The undersigned is directed to refer to this Department’s instructions regarding fixation of pay of All India Service Officers on grant of proforma promotion, issued vide letter No. 14021/5/2008-AIS-II, dated 29.09.2008,wherein it is provided that:

‘In case an IAS officer on deputation to a post gets promoted in his cadre to a post in a higher grade, his pay in the pay band will be fixed with 
reference to the pay in the pay band of the officer immediately junior to him in the cadre of his service. However, the officer in question would continue to draw the grade pay attached to the deputation post for the remaining duration of the deputation.”

However, in certain cases, it has been noticed that the pay of All India Service Officers, on grant of proforma promotion to a higher grade in the parent cadre, has been fixed with reference to the pay of a junior in the cadre who was already drawing more pay than the senior officer even before promotion on account of greater length of his service. It has also been noticed that officers, who get proforma promotion in relaxation of Next Below Rule in terms of DOPT O.M. No.8/8/84/Estt.(Pay. I), dated 15.07.1985 as no immediate junior is available for appointment to the higher grade against an available vacancy in the cadre, have sought to get their pay fixed with reference to the pay of a junior in the cadre who has not even been promoted to the higher scale in which they have got proforrna promotion.

3. The matter has been examined in consultation with the Ministry of Finance, Department of Expenditure and it s clarified that fixation of pay on 
grant of proforma promotion with reference to the pay of junior only means that the pay in pay-band or pay-scale may be fixed in terms of normal rules applicable in the case of fixation of pay of junior in State cadre by grant of one increment @ 3% of basic pay, subject to the maximum of pay band-4 or the pay scale. However, where the deputation post is in any pay band with a grade pay, the grade pay would remain unchanged and where the deputation post is in a pay scale, the pay scale would remain unchanged.

Major Penalty Proceedings Recommened Against 113 Officers

CVC Disposed of 1272 cases in December 2011  Major Penalty Proceedings Recommened Against 113 Officers


The Central Vigilance Commission (CVC) disposed of 1272 cases during December 2011 referred to it for advice. Of these, 1096 complaints were sent for necessary action/ATR whereas 88 complaints were sent for investigation and report. No action was required on 226 complaints.

The Commission advised issuance of sanction for prosecution in respect of 16 officials of various Ministries/Departments/Organizations. Prosecution sanctioned by the Competent Authority in 7 cases during the month which includes two separate cases in respect of one IPS & One IAS officer. It also processed 1836 complaints (including 217 whistle blower complaints) during the month and sought Investigation/Factual report in 68 complaints from the concerned Ministries/Departments/Organisations.

The Commission advised initiation of major penalty proceedings against 113 officials of various Ministries/Departments/Organisations which includes one General Manager of Corporation Bank, one Director of D/o Mines, one Chief Commissioner of Central Board of Excise & Customs (CBEC) and one Executive Director (ED) of Steel Authority of India Ltd. (SAIL).

The Commission also advised imposition of major penalty against 45 of various Ministries/Departments/Organisations which includes a Chief Engineer of M/o Shipping, a Chief General Manager (CGM) and General Manager (GM) each of Industrial Development Bank of India (IDBI), Commissioner of Income Tax of Central Board of Direct Taxes (CBDT), the then Chief Executive Officer (CEO) of Ministry of Defence and the then Director (HR) of Gas Authority of India (GAIL) under M/o Petroleum & Natural Gas, one General Manager of National Small Industries Corpn. Ltd. and a Chief General Manager and General Manager of South Eastern Coalfields Ltd.

On the advice of the Commission, the Competent Authority has imposed major penalties in respect 60 officials of various Ministries/Departments/Organisations.

Chief Technical Examiners Organisation of the Commission submitted 7 technical examination reports and these examinations resulted in recovery of Rs. 14,82,51,858/- during December, 2011. Thus, the total recoveries effected during the year 2011 works out to Rs. 88.90 crores. Vigilance clearances were accorded for 18 empanelment/board level appointment
