Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay

OFFICE MEMORANDUM

Subject:- Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or after 1.1.2006 in case. inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10)to the existing pay in the pay band and then fixing the pay in the promotional post as per the procedure prescribed therein.

2. In terms of this Ministry’s OM No. 169/2/2000-IC dated 24.11.2000, dealing with the situation whereby both the feeder and the promotional grades were placed in the identical revised pay scales based on the recommendations of the 5th Central Pay Commission, it was provided, inter-alia, that only in cases where it was not found feasible to appropriately restructure cadres in question on functional, operational and administrative considerations, extension of the benefit of fixation of pay under FR 22(I)(a)(1) could be considered on the merits of each case, provided all the conditions precedent for the grant of this benefit were fully satisfied and promotion to the post in question actually involved assumption of higher responsibilities.

3. In view of the provisions which existed prior to 1.12006., the matter has been considered and the President is pleased to decide that in cases of promotion from one post to another where the promotional post carries the same Grade Pay as the feeder post, the fixation of pay in such cases will be done in the manner as prescribed in Rule 13(i) of the CCS(RP) Rules, 2008, provided fixation of pay in such cases was done prior to 1.1.2006 in terms of this Ministry’s aforesaid OM No.169/2/2000-IC dated 24 11.2000.

4. In so far as the persons serving the Indian Audit and Account Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India.

Subject: Central Civil Services (Revised Pay) Rules, 2008 – the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.

The undersigned is directed to invite a reference to Rules 5 & 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.
2. This Ministry issued instructions vide this Departments OM No. 10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pie-revised pay scale as a onetime measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules 2008.
3. In view of the benefit extended to Central Government employees as per the aforesaid OM dated 19.3.2012, the issue relating to according of a fresh opportunity to Central Government employees to re-exercise their option to come over to the revised pay scale as per CCS(RP) Rules, 2008 was raised by the Staff side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.
4 The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid OM dated 19.3.2012 brIng about a material change in the basis for exercise of option to come over to the revised pay structure in terms of the CCS(RP) Rules, 2008 in respect of employees who are covered under the said OM dated 19.3.2012, the President is pleased to decide that all those employees who are covered under the provisions of the aforesaid OM dated 19.3.2012 may once again be permitted to re-exercise their option to come over to the Revised pay structure.
5. The benefit under these orders for re-exercise of option shall be available for a period up to 31.3.2013. The revised option shall be intimated to the head of the office by the concerned Government employees in accordance with the provision of Rule 6 (2) of the CCS (RP) rules, 2008.
6. All the Ministries and Departments are requested to bring the content of this OM to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.
7. In so far as persons serving in the Indian Audd and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.

In the Government Orders sixth and eighth cited, orders have been issued revising the scales of pay of the following teaching categories notionally with effect from 1—1—2006 with monetary benefit from 1—1—2011:-

3) Various Teacher Associations / Pensioners Associations / Individuals /Retired Teachers have requested clarification on the fixation of pay in the Selection Grade / Special Grade posts respectively, consequent on the revision of Ordinary Grade scales of pay of the categories of posts mentioned above. Similarly, the
Accountant General has also sought clarification as to whether the restrictive provision as mentioned in para-4 (i) of the Government letter third cited is applicable in respect of Teachers.

4) The issue has been examined in detail in consultation with the School Education Department and also with the Directors of School Education / Elementary Education. Based on the remarks furnished by the Heads of Departments in accordance with the service rules the issue of allowing Selection Grade / Special
Grade scales of pay to Teachers as indicated in Annexure—I of the Government letter third cited has been examined by Government. As per the provisions in adhoc rules, it has been reported that the first level and second level promotion post for the post of B.T. Assistant (Rs.9300—34800 + Grade Pay Rs.4600) is Head Master High School (Rs.9300—34800 + Grade Pay Rs.4800) and Head Master Higher Secondary School (if qualified) / District Educational Officer (Rs.15600—39100 + Grade Pay Rs.5700), for Head Master High School (Rs.9300—34800 + Grade Pay Rs.4800) is P.G. Assistant (Rs.9300—34800 + Grade Pay Rs.4800) / Head Master Higher Secondary School (if qualified) / District Educational Officer (Rs.15600— 39100 + Grade Pay of Rs.5700). In respect of P.G. Assistant (Rs.9300—34800 +
Grade Pay Rs.4800) first and second level promotion posts are Head Master Higher Secondary School (Rs.15600—39100 + Grade Pay Rs.5700) and Chief Educational Officer (Rs.15600—39100 + Grade Pay of Rs.6600). The Primary School Head Masters (Rs.9300—34800 + Grade Pay Rs.4500) and Middle School Head Masters(Rs.9300—34800 + Grade Pay Rs.4700) those who have acquired B.A./ B.Sc./ B Lit. plus B.Ed. qualification alone are eligible for promotion as B.T. Assistant in Middle School and Head Master Middle School by virtue of their seniority. Considering the first and second level promotional posts of the Teachers, they are entitled for the revised Selection Grade / Special Grade scales of pay as indicated in Annexure—I subject to the conditions stipulated in para—4(i) of the Government letter third cited.
Accordingly, I am directed to indicate the revised Selection Grade / Special Grade scales of pay of the teachers consequent on the revision of their Ordinary Grade scales of pay in Government Orders sixth and eighth cited as shown below:--

The above Selection Grade / Special Grade scales of pay is applicable only to Teachers awarded Selection Grade / Special Grade prior to 1--1--2006 and Teachers who have opted for the revised scale of pay on a subsequent date between 1--1--2006 and 31--5--2009 i.e. from the date of their award of Selection Grade / Special Grade. Further, the above Selection Grade / Special Grade scales of pay shall also take notional effect from 1—1—2006 or from the date of exercising revised option as the case may be and with
monetary benefit from 1—1—2011.

5) The Heads of Department / Pay fixing authorities concerned are requested to fix the pay of teachers in the appropriate scales of pay indicated in para—4 above. Further, the Selection Grade / Special Grade scales of pay indicated above may also be taken into account for the purpose of revision of Pension / Family Pension in respect of the retired teachers who seek revision of their Pension / Family Pension with reference to para -2 (vi) of Government Order second cited.

Fixation of Pay of All India Services on the grant of proforma promotion

Sub: Fixation of Pay of All India Services on the grant of proforma promotion - regarding.

The undersigned is directed to refer to this Department’s instructions regarding fixation of pay of All India Service Officers on grant of proforma promotion, issued vide letter No. 14021/5/2008-AIS-II, dated 29.09.2008,wherein it is provided that:

‘In case an IAS officer on deputation to a post gets promoted in his cadre to a post in a higher grade, his pay in the pay band will be fixed with 
reference to the pay in the pay band of the officer immediately junior to him in the cadre of his service. However, the officer in question would continue to draw the grade pay attached to the deputation post for the remaining duration of the deputation.”

2. However, in certain cases, it has been noticed that the pay of All India Service Officers, on grant of proforma promotion to a higher grade in the parent cadre, has been fixed with reference to the pay of a junior in the cadre who was already drawing more pay than the senior officer even before promotion on account of greater length of his service. It has also been noticed that officers, who get proforma promotion in relaxation of Next Below Rule in terms of DOPT O.M. No.8/8/84/Estt.(Pay. I), dated 15.07.1985 as no immediate junior is available for appointment to the higher grade against an available vacancy in the cadre, have sought to get their pay fixed with reference to the pay of a junior in the cadre who has not even been promoted to the higher scale in which they have got proforrna promotion.

3. The matter has been examined in consultation with the Ministry of Finance, Department of Expenditure and it s clarified that fixation of pay on 
grant of proforma promotion with reference to the pay of junior only means that the pay in pay-band or pay-scale may be fixed in terms of normal rules applicable in the case of fixation of pay of junior in State cadre by grant of one increment @ 3% of basic pay, subject to the maximum of pay band-4 or the pay scale. However, where the deputation post is in any pay band with a grade pay, the grade pay would remain unchanged and where the deputation post is in a pay scale, the pay scale would remain unchanged.
