Representation of various categories at higher positions in the Central Government

OFFICE MEMORANDUM 

Sub: Representation of various categories at higher positions in the  Central Government. 

The Parliamentary Committees on "Welfare of Scheduled Castes, Scheduled Tribes" and "Welfare of Other Backward Classes" are deliberating on the issue of representation of SCs, STs and OBCs at higher positions in the Central Government. The Committees have asked DOPT to furnish details of 
officers holding senior positions in the Central Government. Such type of information as well as information about Persons with Disabilities (PWD) and persons belonging to minority community is also sought for through various Parliament Questions. 

2.  In view of the above, it has been decided to collect the said information in the Central Government. All Ministries /Departments are, therefore, requested to furnish the detail of officers at higher positions in the enclosed prescribed proforma to this Department latest by 31" July, 2012.

SC refuses to stay AP High Court order on quota issue

The apex court expressed its "unhappiness" that the Centre was blaming the High Court when it had itself failed to produce documents to support its case.

A Bench of justices K S Radhakrishnan and J S Khehar was critical of the Ministry of Human Resource Development rushing to the apex court with the appeal against the May 28 order of the High Court without documents to justify the policy of carving out 4.5 per cent sub-quota within the 27 per cent OBC reservation.

Without issuing any notice, the bench asked Attorney General G E Vahanvati to produce before it the supporting documents on the issue by tomorrow and posted the matter for hearing on Wednesday.

The bench said it cannot stay the high court order "unless the government produces material to show a detailed exercise was undertaken to carve out the sub-quota."

The Attorney General started submissions by taking "blame on his shoulders" for the outcome of sub-quota policy in the high court by saying that the "argument was not the most brilliant".

He sought some protection in view of the ongoing counselling for IITs for which 325 candidates have qualified for it under the 4.5 per cent sub quota and their career and future could be jeopardised if they are not allowed to appear for the counselling.

When Vahanvati said there was need for some protection in view of the ongoing counselling for IITs, the bench said "we will not order stay".

"First of all you have not produced any documents in the high court. We would have been happy, if you had done so," the bench said.

The bench wanted to know from the senior most law officer as to what was the basis and how did the government determine 4.5 percent sub-quota for minorities.

When the Attorney General sought to point out errors in the high court order, the bench said it was natural for the high court to ask questions on which the Centre was complaining.

The bench, which was not in agreement with Vahanvati that the "High Court has gone completely wrong," said "when the December 22, 2011 Office Memorandum (OM)(on 4.5 per cent sub quota) reflected nothing, the High Court will ask questions".

"Without placing documents how can you find fault with the high court (order)," the bench said adding that "where is the material and the High Court says nothing is produced."

When Vahanvati said the High Court also missed the 1993 notification on the caste identification, the bench wanted to know whether it was placed before it or not.

The Attorney General said he was told that a reference was made about it but not placed.

At this the bench said, "how can you then point out error in the High Court judgement."

The bench also questioned the government saying "how can you (Centre) break up the 27 percent OBC quota."

"It is a complex matter, you are carving out sub-quota from 27 percent quota. Tomorrow you will carve out further quota," it said.

Three per cent quota in government service for the disabled is only for initial appointments, and the government cannot be directed to extend it for promotions, ruled the Madras High Court on Monday.

Dismissing a petition seeking a direction to the government to reserve three per cent for promotions to physically handicapped persons, Justice K. Chandru said: “The provisions are contemplated only for initial appointments and not for promotions. The petitioner has not made out any case to seek a direction to provide for reservation for the disabled persons in the matter of promotions in respect of State services.”

The writ petition was filed by the South Arcot Vallalar District Handicapped Welfare Association, represented by its president S. Shanmugam, seeking reservation for the disabled in promotions. If suitable employees were not available in a particular year, the unfilled posts could be carried over for the next three succeeding years.

When the matter was heard, the State Commissioner for the Disabled stated that there was no government policy to reserve three per cent of posts in promotions to be filled from the disabled category.

The disabled persons were considered only for the direct recruitment posts under three per cent reservation as per a G.O issued in 1981. Promotions were made in government departments based on seniority or transfer of service.

Mr. Justice Chandru said it could be seen from the G.O. that reservation for disabled persons was only horizontal and not vertical as contemplated in Article 16 of the Constitution.

He said that even in respect of the Scheduled Castes and Scheduled Tribes, it was only by virtue of amendments made to the Constitution and by introduction of Article 16(4A) that the State had been empowered to make provision for reservation in promotion to any class or classes of posts in the service

The Madras High Court Bench here on Friday questioned the State government for continuing reservations to ‘creamy layer' among the backward classes

Status quo ordered by Supreme Court expired in July last year

The Madras High Court Bench here on Friday questioned the State government for continuing reservations to ‘creamy layer' among the backward classes though the status quo ordered by the Supreme Court for a year lapsed on July 13, 2011.

A Division Bench of Justices P. Jyothimani and S. Vimala posed the question to Additional Advocate General (AAG) K. Chellapandian while hearing a public interest litigation petition seeking MBC status for all those falling under the common nomenclature Thevar.

When the AAG sought time to obtain instructions, the judges adjourned the hearing without mentioning a date as the Tamil Nadu Backward Classes Commission's (TNBCC) report, submitted to the Chief Minister on July 8, was yet to be tabled in the Assembly and made public.

Three days after the report was submitted, a government order was issued on July 11 stating that the 69 per cent reservation (30 per cent for BCs, 20 per cent for MBCs, 18 per cent for SCs and one per cent for STs) would continue without excluding the creamy layer. In the present PIL petition, B. Stalin, a lawyer from Ettimangalam near here, has sought a direction to the State government to classify all sub-castes falling under the category of Thevar as Most Backward Classes in order to avail reservations in education and government employment.

His counsel W. Peter Ramesh Kumar relied upon a G.O. passed in September 1995 to claim such a benefit. The G.O. had renamed the Mukkulathor community as Thevar, which included the subdivisions of Agamudaiyar, Maravar and Kallar.

Agamudaiyar is a common name for those belonging to Kottai Patru, Servaikkaran, Raajakulam, Irumbuthalai, Desikar, Malainaadu, Aivali Nattan, Raajaboja, Naattumangalam and Raajavaasal castes. Kallar comprises Ambunattu Kallar, Vazhanattu Kallar, Koothappar Kallar, Periyasuriyur Kallar, Gandarvakottai Kallar, Esanattu Kallar and Piramalai Kallar.

Those belonging to Maravan, Valangai Maran, Vilangu Thevan, Vetchi Karanthai, Thevan, Puli Maran, Gora Maran, Madurai Thevan, Thumbai, Komban, Vallai Thevan, Neela Maran, Pattamkatti, Thalumban, Purayar, Kottravaien Sayon and Alakiya Pandian castes are called Maravar in general.

Claim refuted

Refuting the petitioner's claim on the basis of the 1995 G.O., the government filed a counter affidavit on July 5 last and pointed out that the G.O. changed only the nomenclature and did not reclassify the caste groups from BC to MBC as claimed by the petitioner.

The counter filed by a Deputy Secretary of the Backward Classes, Most Backward Classes and Minorities Welfare Department also stated that a decision on reclassifying all castes and sub-castes falling under the common nomenclature Thevar could be taken only after the completion of the ongoing caste-based census.

He said even at the time of issuing of the G.O., it was made clear that a decision on reclassification of these castes would be taken only on the basis of recommendations to be made by the TNBCC. The matter was, in fact, referred to the TNBCC headed by a retired High Court judge in 1995 itself. But, “the above issue is still pending in the Commission for want of socio, educational and economic details of those communities. The Commission (in its meeting held on September 8, 2009) has decided to defer the issue till a caste wise survey is conducted in the State.”

Annual Reports regarding Representation of SCs, STs, OBCs and Persons with Disabilities in the Central Government Services as on 1.1.2012

Office Memorandum

Subject:- Annual Reports regarding Representation of SCs, STs, OBCs and Persons with Disabilities in the Central Government Services as on 1.1.2012.

   The undersigned is directed to say that as per instructions contained in this Department’s O.M. No.43011/10./2002-Estt.(Res.) dated 19.12.2003 and O.M. No 36035/3/2004-Estt.(Res.) dated 29.12.2005, each Ministry/Department is required to send following reports to this Department by 31.3.2012 :-


   (i) SC/ST/OBC Report-I regarding representation of SCs, STs, and OBCs in services as on 1.1.2012 and number of appointments made during the calendar year 2011.

   (ii) SC/ST/OBC Report-II regarding representation of SCs, STs, OBCs in various grades of organized Group ‘A’ services as on 1.1.2012;

   (iii) Persons with Disabilities (PWD) Report-I regarding representation of persons with disabilities in services as on 1.1.2012 ; and

   (iv) PWD Report-II regarding appointments persons with disabilities during the year 2011.

   2. The proformae prescribed for above reports are enclosed for ready reference. It is request that the reports may be sent to this Department by stipulated date i.e.by 31.3.2012. While collecting information from the attached/Subordinate offices, the concerned offices may be advised not to send information direct to this Department. The concerned Ministry/Department should consolidate the information in respect of entire Ministry /Department including the information in respect of the Attached and Subordinate Office, and send such consolidated information to this Department.

   3. The Ministries/Department should ensure that the reports sent to this Department contain consolidated information in respect of the concerned Ministry/Department and its Attached and Subordinate Offices only.

   4. Information in respect of the Statutory, Semi-Government and Autonomous Bodies may be collected and maintained by the concerned administrative Ministries/Departments but the same should not be sent to this Department. Similarly, the Department of Public Enterprises may collect similar information in respect of all public sector undertaking and may maintain it.

   5. As the information called for relates to persons and not to posts, the posts, which are lying vacant, should not be taken into account. Persons on deputation should be included in the establishment of borrowing Ministry/Department/Office and not in the establishment of their parent office. Persons permanent in one grade but officiating or holding temporary appointment in a higher grade should be shown in the figures relating to the class of service in which the higher grade concerned is included. It may also be noted that figures in respect of Scheduled Castes, Scheduled Tribes, Other Backward Classes and Persons with Disabilities have to include persons appointed by reservation as well as appointed on their own merit.

Reservation for Minorities

Reservation for Minorities
The National Commission for Religious & Linguistic Minorities has, inter alia, recommended that 15 percent of posts in all cadres and grades under the Central and State Governments should be earmarked for minorities, of which 10 percent should be for Muslims and 5 percent for other minorities. The Commission has further stated that if it is not possible to give reservation as proposed above, 8.4 percent sub-quota may be earmarked for minorities (6 percent for Muslims and 2.4 percent for other minorities) within 27 percent OBC quota. The recommendation is under consideration of the Government. It is, however, not possible to fix time frame for taking a decision. 

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri V.Narayanasamy in written reply to question in the Lok Sabha today.

Special Drive to Fill up Vacant Posts Of SCs/STs/OBCs/PWDs


     The Government has launched a drive to fulfil the backlog vacancies of Scheduled Castes, Scheduled Tribes and OBCs and Persons with Disabilities (PWDs). The number of backlog vacancies is 57947. The bifurcation is : SC- 15323, ST – 20301, OBC – 15323 and PWD – 7000. This follows review of the vacancy position in these categories by the Union Minister of State for Personnel, Public Grievances & Pension, Shri V. Narayansamy recently. All Ministries/Departments have been directed to fill up all the vacant posts in these categories by March 31, 2012.

     The Government has been concerned about non-filling up of large number of backlog vacancies reserved for SCs/STs/OBCs/PWDs. Two Special Recruitment Drives – one for SCs, STs and OBCs another for PWDs were launched in 2008 and 2009 respectively. The Drives enabled various offices to fill up about 26750 backlog vacancies.

Amendments in the Central Lists of Other Backward Classes (OBCs)

The Union Cabinet  approved the inclusion of the names of some castes and communities in the Central List of OBCs.

The National Commission for Backward Classes advised the Central Government for amendment in the Central list of Other Backward Classes (OBCs) for the States of Andhra Pradesh, Bihar, Goa, Gujarat, Himachal Pradesh, Karnataka, Madhya Pradesh, Maharashtra, Orissa, Rajasthan, Tamil Nadu, Uttar Pradesh, Uttarakhand, West Bengal and Union Territories(UTs) of Andaman & Nicobar Islands & Puducherry.

Accordingly, the Ministry of Social Justice & Empowerment will make amendments in the Central lists of OBCs in respect of these States and UTs. Inclusion of these castes/communities in the Central list of OBCs would enable them to avail the benefits of reservation in Central Government services and posts as well as in the Central education institutions, thus contributing to the goal of equity and inclusiveness.
