Subject : Rotational Transfer Policy applicable to CSS Officers – Review of the policy reg.

The undersigned is directed to refer to the subject mentioned above and to say that the following provision is proposed to be added in the rotational transfer policy for CSS/CSSS Officers:

“Officers returning from deputation/ long leave/ long term training etc.: An Officer repatriating from deputation, returning from long leave/ long term training will be posted back to the same Ministry/ Department he last served for the balance period of the tenure prescribed for the grade subject to availability of a vacancy and subject to the condition that at least one year of balance tenure is left. In the absence of a vacancy in the last Ministry/ Department served, he will be allowed to exercise option for posting treating the last served Ministry/ Department as his current group. On expiry of the retention for the balance tenure, the officer will be transferred on rotational transfer.

Period of leave/ training exceeding six months will be treated as long leave/ long term training for the purpose of posting under RTP.

Officers to be retained on promotion in the same Ministry/ Department in terms of the RTP would be adjusted first and only thereafter officers returning from deputation, long leave or training would be considered for retention, subject to availability of vacancy.”

Use of Postal Stamps for Payment of RTI Fees not Feasible - DOPT

Postal Stamps as RTI Fee

The Government has constituted a committee consisting of representatives of Department of Personnel & Training, Central Information Commission, Department of Posts and Office of Controller of Accounts (Department of Personnel & Training) to examine whether postal stamps can be used for payment of RTI fees under the Right to Information Act, 2005. The Committee has given its report on 24.02.2015. The Committee has observed that the use of postage stamps as mode of payment for RTI fee/costs is neither legally feasible nor feasible from the accounting point of view. Moreover, it would not be in line with the Government initiatives towards Digital India. Hence, the Committee has recommended that postage stamps may not be used as mode of payment for RTI fee/costs. The report of the Committee has been accepted by the competent authority.

The Central Government has already launched RTI Online portal for online filing of RTI applications, including online payment of RTI fee/costs. Moreover, the facility of eIPO (electronic India Postal Order) has been launched for purchase of IPOs electronically by online payment.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri Dhananjay Mahadik, Shri Satav Rajeev, Dr. Heena Vijaykumar Gavit and Shri Mohite Patil Vijayasinh Shankarrao in the Lok Sabha today

No proposal under consideration for including more places under the conversion of Home Town LTC to All India LTC

LTC to Some Countries

A proposal to provide Leave Travel Concession (LTC) to Government employees to visit some SAARC countries is in its initial stage of consideration. The details are yet to be finalized.

The purpose behind the proposal is to enhance people-to-people contact and bilateral ties in the SAARC region through increase in tourism in the region.


As per the Government’s order dated 26.09.2014, the Government has extended the facility of conversion of home town LTC to visit the states in the North East Region, Jammu & Kashmir and the UT of Andaman & Nicobar Islands for a period of two years up to 25.09.2016. This facility was first introduced in the year 2008.

Presently, no other proposal is under consideration for including more places under the conversion of Home Town LTC to anywhere in the country.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri M. Raja Mohan Reddy in the Lok Sabha today

Subject: Rotational Transfer of Section Officers with more than 16 years of service in the same Ministry/Department.

The undersigned is directed to refer to this Department’s Order of even No. dated 10 May, 2012 by which the Section Officers, who have put in more than 16 years service in a particular Cadre Unit, have been transferred and posted to other Cadre Units

2. All the Cadre Units were requested to relieve the officers concerned immediately. However, a number of Section Officers included in the said order have not been relieved by the Cadre Units concerned.

3. As per the CSS Rules, 2009 amended vide notification dated September,2010, it shall be the duty of the Cadre Units concerned to relieve the officer concerned within 45 days on receipt of the transfer order or further such period, if any, allowed by the Department of Personnel & Training (DOP&T) for reasons to be recorded in writing. If an officer is not relieved within 45 days or such further period as referred to above, the officer shall be ‘deemed’ to have been relieved by the cadre unit in which he is working and thereafter the officer shall not be entitled to draw salary and allowances for the period of such overstay in the cadre unit from where the officer was transferred.

4. The period of 45 days as envisaged in the notification will be over on 24th June, 2012 Therefore, the Cadre Units concerned are requested to relieve the remaining Section Officers, whose names appear in the said order, immediately. if not already done, latest by 24”' June, 2012. Section Officers included in the list, who do not join in the new Cadre Unit by the end of this month, will not be entitled to draw the salary and allowances from .24th June, 2012 onwards from the Cadre Unit

The undersigned is directed to refer to this Department’s OM of even number dated 11th  April 2012 whereby Cadre Units were requested to furnish information/preference of posting of Assistants who have completed more than 16 years of service in any capacity in a particular Ministry/Department (excluding those who are due for superannuation within two years as on 01.0 1.2012).

2. It is noticed that a number of cadre units have not furnished the requisite information so far. The defaulting Cadre Units addressed below are therefore, requested to furnish information/preference of posting of Assistants who have completed more than 16 years of service in any
capacity in a particular Ministry/Department (excluding those who are due for superannuation within two years as on 01.01.2012) to this Division immediately.

Encashment of 300 days of Earned Leave for Defence and other Industrial employees other than Railways

Many of our readers have requested to provide the orders and clarifications of DOP&T regarding the matter of 300 Days EL encashment for Central Government Civilian Employees other than Railways

The Industrial Employees other than Railways were not allowed to accumulation of EL upto 300days and it was limited to 120 days before the issuance of order on 07/11/2006. It was a long pending demand of Staff Side Members of National Council JCM to grant of accumulation and encashment of 300 days of earned leave and it was agreed and granted with effect from the date of issue of the order that is from 07th November 2006. The employees those who were retiring on and after 07/11/2006 were unable to encash the Earned Leave to the extent of 300 days since they were restricted to accumulate their EL upto 120 days only. Due to that they couldn’t avail the benefit of encashment of 300 days EL at that time.

This anomaly had been removed after a long struggle and necessary order was issued on 25th September 2008 regarding the issue of shortfall in Earned Leave . To make up the shortfall in Earned Leave it had been decided by the government that in supersession of all earlier orders on the subject, both Earned Leave and Half Pay Leave shall be considered for encashment of leave subject to overall limit of 300 days. The cash equivalent payable for Earned Leave shall continue unchanged. However, cash equivalent payable for Half Pay Leave shall be equal to leave salary as admissible for Half Pay Leave plus Dearness Allowance admissible on the leave salary without any reduction being made on account of pension and pension equivalent of other retirement benefits payable.

Subject:- Grant of accumulation and encashment of 300 days of earned leave for Defence and other Industrial employees (other than Railways).

The undersigned is directed to refer to this Department’s O.M. No. 12012/5/86-Estt.(L) dated 9th January 1992, according to which the total accumulation of earned leave in respect of industrial employees other than Railways, was limited to 120 days. Consequent to discussions with the Staff Side of the National Council(JCM), it has been decided, in consultation with the Ministry of Finance (Deparunent of Expenditure), to allow accumulation and encashment of earned leave to the extent of 300 days for Defence and other industrial employees.

2. The other terms and conditions applicable to industrial employees (other than Railways) shall remain the same.

3. These orders shall take effect from the date of issue.

Subject:- Recommendations of the Sixth Central Pay Commission relating to encashment of leave in respect of Central Government civilian employees.

Consequent upon the decisions taken by the Government on the recommendations of the Sixth Central Pay Commission relating to encashment of leave in respect of Central Government civilian employees, the President is pleased to decide that in supersession of all earlier orders on the subject, both Earned Leave and Half Pay Leave shall be considered for encashment of leave subject to overall limit of 300 days. The cash equivalent payable for Earned Leave shall continue unchanged. However, cash equivalent payable for Half Pay Leave shall be equal to leave salary as admissible for Half Pay Leave plus Dearness Allowance admissible on the leave salary without any reduction being made on account of pension and pension equivalent of other retirement benefits payable. To make up the shortfall in Earned Leave, no commutation of Half Pay Leave shall be permissible. In pursuance of amendment to Central Civil Services (Revised Pay) Rules,2008 vide Ministry of Finance (Department of Expenditure) notification dated 16th  July, 2009, the entries "grade pay of Rs.12000 or lower" in Para (i) of the scheme shall be substituted with "HAG scale of Rs.67000-(annual increment @ 3%)-79000"
2.  Promotion of Scientists in Department of Space, Atomic Energy and DRDO would be in accordance with the provisions under the Merit Promotion Schemes in these Departments.

CADRE REVIEW

Cadre review is an important aspect of cadre management. It ensures a healthy balance between the functional requirements of an organisation and legitimate career aspirations of its officers. The thrust of such an exercise is on scientific manpower projection and recruitment planning in order to rationalise the cadre structure as also to enhance efficiency, morale and effectiveness of the service/cadre. In terms of the extant guidelines, ideal periodicity of cadre review is once ever y five years .


The Department of Personnel and Training, being the nodal Department for cadre review of all Group ‘A’ Central Services/Cadres, has issued various guidelines to facilitate the process. Cadre Review as a subject has been allocated to the Cadre Review Division, which also acts as the Secretariat for Cadre Review Committee constituted to review individual service/cadre. The cadre review proposals are scrutinised in this Division keeping in view the  broad factors like functional requirements, stagnation at various levels, financial implications, measures for saving, organisational proficiency, etc . The proposals are then referred to the Department of Expenditure for financial concurrence and placed before the Cadre Review Committee for its approval. The Division also renders advice to the Cadre Controlling Authorities for better cadre management.

The status of Group ‘A’ Services is reviewed regularly. After first such review this year in April, all the concerned Departments were advised by the Cabinet Secretary to formulate appropriate cadre review proposals. Further, Para 1(ix) of the Government of India, Department of Expenditure Resolution No.1/1/2008-IC   dated 29 August,  2008, whereby its decisions on the recommendations of 6th Central Pay Commission have been conveyed enjoins upon all the Cadre Controlling Authorities to review the services/cadres under the administrative control within a year. The Cadre Controlling Authorities have been reminded again October 2008.

There are 58 Central Group ‘A’ Services, out of which 44 services are due for cadre review this year, i.e., 2008.  The cadre review proposals of five of the remaining forty four Group ‘A’ Services are already under active consideration. These are Indian

CADRE REVIEW

Defence Service of Engineers and Military Engineering Service (Surveyor Cadre), Military Engineering Service (Architect Cadre), Indian Inspection Service and Indian Supply Service The progress is being monitored constantly.

The Cadre Review Division also compiles and analyses statistical information of all the Central Group ‘A’ Services. The inconsistencies, if noted during the analysis, are brought to the notice of the concerned Cadre Controlling Authority. This exercise is undertaken on half yearly basis in January and July every year. The data as on 1st January, 2008 has already been compiled and analysed. The detailed report in this regard is also posted on this Department’s website. However, it has been decided that the next analysis would be done only after completion of cadre review of all the services envisaged in the Government’s Resolution mentioned above.

Notional fixation of pay to officers included in the Deputy Secretary Select List 2009 and 2010

Subject: Notional fixation of pay to officers included in the Deputy Secretary Select List 2009 and 2010 reg.

As per DPC guidelines promotions are effective from a prospective date. However, in the case of Central Secretariat Service. Select Lists for the Selection Grade (Deputy Secretary) for certain years got delayed due to protracted litigation over the question of inter-se seniority between the direct recruit and promotee Section Officers.

2. In consideration of the above facts, extending the benefit of notional fixation of pay to CSS Grade I officers on their promotion to the Selection Grade from the lit July of the Select  List year. which is the date for counting approved service in all grade of CSS, was allowed till the Select List Year 2007. 2008 was a no panel year for promotion to the grade of Deputy Secretary. For the Deputy Secretary Select List years 2009 and 2010, no such benefit has been extended.

3 The Office Order issued by CS Division promoting the CSS Grade I officers against 
DSSL 2009 specifically mentioned that the pay and allowances of the officers are to be fixed under FR 22 (1) (a) (i) w.e.f the date of taking over the charge of Deputy Secretary on regular basis. No separate instructions for fixation of pay on a notional basis from 1ST July. of the Select List year in respect of officers who have been included in DSSL 2009 or DSSL 2010 have been issued

4 It has, however, come to notice of this Department that some of the Ministries/Departments have fixed the pay of Grade I Officers of CSS on their promotion as Deputy Secretaries against DSSL 2009 and 2010 notionally with effect from 1/7/2009 and 1ST July. 2010 respectively, which is not consistent with extant rules on the subject and without any specific instructions in this regard by CS Division of DOP&T. All the Ministries/Departments are, therefore, requested to review the cases of fixation of pay of Grade-I officers ( Under Secretaries) of CSS on their promotion to the Selection Grade (Deputy Secretary) against the Select List years 2009 and 2010 and take steps to rectify the pay fixation in those cases where the benefit of notional fixation of pay has been incorrectly extended.

Subject: Stepping up of pay of senior member of All India Service vis-à-vis pay of his junior in the cadre — regarding.

Sir, 
I am directed to say that references from various State Governments regarding anomalies in the pay of senior members of All India Services vis-a vis pay of their juniors in the cadre who have been promoted to the Service or to a higher grade in the Service subsequent to the seniors, have been engaging attention of this Department.

2. The matter has been examined with reference to the existing instructions of the Government on this subject and it is stated that such anomalies on account of fixation of pay on promotion, including the promotion from State service to All India Services, can be solved by stepping up the pay of the senior member of Service at par with the pay of the junior in the cadre from the date when the anomaly arose, subject to fulfillment of following conditions:

(j) Both junior and senior should belong to the same cadre both in lower and higher grade. In the case of anomaly in the pay of officers promoted from State service to IAS/IPS/IFS in a State cadre, both junior and senior should belong to same cadre in the State Service (lower grade).

(ii) Anomaly must have arisen as a result of fixation of pay either on promotion from one grade to another in IASIIPS/IFS or on promotion from State service to IAS/IPS/IFS, as the case may be.

(iii) Posts in higher and lower grade must be identical and in lower grade senior must not be drawing less pay than junior for whatsoever reasons For example if the junior officer draws higher rate of pay than the senior in the lower post or State service post by virtue of advance increments or on any other account, the above provisions will not be invoked to step up the pay of the senior officer.

Many families are struggling to get family pension, due to the confusion in submitting the list of Documents after the death of the pensioner /family pensioner .Various Ministries/Departments of the Government sought clarification from DOP&T regarding the documents for family pension, including certificate of income, required to be submitted by a claimant member of family (other than spouse) along with application form (Form 14), PPO and death certificate after the death of a pensioner/family pensioner. DOP&T now issued a clarification on this.

Office Memorandum

Sub: Family pension - list of documents to be submitted by a claimant member of family (other than spouse) along with Form 14. PPO and death certificate in respect of the deceased pensioner/family pensioner regarding.

The Department of Pension & Pensioners Welfare has been receiving references for clarification by various Ministries/Departments of the Government regarding the documents for family pension, including certificate of income, required to be submitted by a claimant member of family (other than spouse) along with application form (Form 14), PPO and death certificate after the death of a pensioner/family pensioner. The matter was also discussed at length in the 20mth meeting of SCOVA held on 21st September, 2011 (item No. 92 of the Minutes refers). It was agreed in the meeting that a list of such documents will be made available at the website of the Department of Pension & Pensioners Welfare. It was pointed out in the meeting that it is indicated in this Departments Office Memorandum No.45/51/97-P&PW(E), dated 21.7.1999 that a self certificate for the income of those who are self employed or are in receipt of income from sources other than employment may be accepted. It was decided to send a copy of this O.M.to all member associations of SCOVA.

2. This is informed that the claims submitted by a claimant member of family (other than spouse) for family pension after the death of a pensioner/family pensioner, in Form 14 and supported by the death certificate and PPO of the pensioner/family pensioner, may be processed in consultation with the Pay and Accounts Officer, who is the custodian of the pension file which contains all relevant Forms and information of the pensioner. In a very rare case where the name of the claimant member is not available in the records of the Head of Office as well as the Pay & Accounts Officer concerned and the claimant member also fails to submit a copy of PPO or Form 3 containing 'Details of Family submitted earlier by the deceased employee/pensioner, the certificates prescribed at serial number 9(v) of Form 14 may be accepted. In addition to these certificates, PAN Card, Matriculation Certificate, Passport. CGHS Card, Driving License Voter’s ID Card and Aadhar Number may also be accepted. Acceptance of voter’s ID card and Aadhar Number is subject to the condition that the pensioner/family pensioner certifies that he/she is not a matriculate and he/she does not have any of the documents mentioned in Form 14 or above Apart from these documents, the Ministries/Departments may accept any other document submitted by the claimant, which may be relied upon and which establishes the relationship of the claimant with the pensioner and/or contains his/her date of birth.

3. The applicant has also to prove that no other surviving member in the family, who may have a prior entitlement for family pension is eligible. For this purpose, the above and/or any other documents, such as marriage/death/income certificates of the other members which may be essential in a given situation may be used.

4. As decided in the SCOVA meeting, a copy of O.M. No.45/51/97-P&PW(E), dated 21.7.1999 is enclosed for circulation to all Ministries/Departments/Associations.

Subject: Level ‘A’ Training Programme at ISTM for U.D.Cs with 5 years’approved service in the grade (29/08/2011 to 23/09/2011).

           The undersigned is directed to inform that UDCs/adhoc Assistants, whose names are given in Annexure I, have been nominated for the Level ‘A’ Training Programme conducted by ISTM w.e.f. 29/08/2011 to 23/09/2011. It is requested that these officials may be relieved of their duties, subject to vigilance clearance and advised to report to Shri Ranjan Kumar Director(Co-ordinator) ISTM, Administrative Block, JNU Campus (Old), New Delhi-110067 at 9 A.M. on 29th August, 2011.

2.      The performance of the officials in the training, as evaluated and reported by ISTM thereof, may be added In their APARs. No request for withdrawal of nomination either from the Ministry/Department or the officer concerned shall be entertained by this Department or the Institute. As the training of the officials and successful completion is necessary for promotion/regularization, the Cadre Units are requested to ensure that the officials nominated to the above programme are relieved in time.

3.       As the aforesaid training includes study tour, officers nominated above may be advised to draw necessary TA/DA advance of Rs.12,000/- each from their respective Ministry/Department. This amount may be released in Cash only and the same shall be collected by ISTM from the participating officials.

4.      Confirmation with regard to the participation of the officials along with their respective bio-data (Annexure-II) may please be sent by 23rd August. 2011 to Shri Ranjan Kumar, Deputy Director (Co-ordinator), ISTM, New Delhi, with a copy to the undersigned. Subject:- Promotion of Personal Assistant (PA) of CSSS to the Private Secretary (PS) Grade of CSSS on ad-hoc basis- reg.

In continuation of this Department’s O.M. of even number dated 8.6.2011 on the above mentioned subject, the undersigned is directed to say that on the basis of information received so far from the Cadre Units, the Competent Authority has decided to nominate the PAs whose names are given in the Annexure to this OM and post them to the Cadre Units indicated against their names for their promotion to the Grade of PS of CSSS on adhoc basis after having been found b'fit' by the DPC and clear from vigilance angle.

2. The ad-hoc appointment of these officials shall take effect from the date they assume charge of the post of PS in the respective Cadre Units. The adhoc appointment shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of PS for regular appointment or to claim seniority in the PS Grade of CSSS. The period of adhoc promotion would be upto 30.9.2011 or till the regular Private Secretaries become available, whichever is earlier.

3. The Cadre Units are requested that the officers shown in the list at Annexure may be relieved, immediately so that they can take up their assignment as PS of CSSS on adhoc basis in the allocated Cadre Units. A copy of the relieving/promotion orders issued by Cadres concerned may be forwarded to this Department immediately

4. Cadre Units are also requested to furnish full details of vacancy remaining unfilled as on 1.9.2011 in the PS Grade to this Department immediately, so that the same can be filled up by promotion on adhoc basis.

NOTIFICATION

New  Delhi, the 28th July, 2011

G.S.R. 585(E).—In exercise of the powers conferred by sub-section (1) of section 3 of 
the All India Services Act. 1951 (61 of 1951), the Central Government, after consultation with  the Governments of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958. namely :—

1  (1) These rules may be caned the All India Services (Death-Cum-Retirement Benefits) Amendment Rules. 2011.

       (2) They shall come into force from the date of their publication in the Official Gazette.In the All India Services (Death-Cum-Retirement Benefits) Rules, 1958, in rule 5,after sub-rule (1), the following sub-rule shall be inserted, namely:

         (`1A) (I) The Central Government may permit a member of service to withdraw his resignation in the public interest on the following conditions, namely :-

(a) that the resignation was tendered by the member of service for some compelling reasons which did not involve any reflection on his integrity, efficiency or conduct and the request for withdrawal of the resignation has been made as a result of a material change in the circumstances which originally compelled him/her to tender the resignation;

(b) that during the period intervening between the date on which the resignation became effective and the date from which the request for withdrawal was made, the conduct of the member concerned was in no way improper;

(e) that the period of absence from duty between the date on which the resignation became effective and the date on which the member is allowed to resume duty as a result of permission to withdraw the resignation is not more than ninety days

(d) that the post, which was vacated by the member of service on the acceptance of his/he resignation or any other comparable post, is available

(ii) Request for withdrawal of a resignation shall not be accepted by the Central Government where a member of service resigns his/her service or post with a view to taking up an appointment in or under a private commercial company or in or under a corporation or company wholly or substantially owned or controlled by the Government or in or under a body controlled or financed by the Government.

(iii) Request for withdrawal of resignation shall not be accepted by the Central Government where a member of the Service resigns from his/her service or post with a view to be associated with, any political parties or any organisation which takes part in politics, or to take part in, or subscribe in aid of, or assist in any other manner, any political movement or political activity or to canvass or otherwise interfere with, or use his/her influence in connection with, or take part in, an election to any legislature or local authority.

(iv) When an order is passed by the Central Government allowing a member to withdraw his/her resignation and to resume duty, the order shall be deemed to include the condonation of interruption in service but the period of interruption shall not count as qualifying service
