Sub: Benefit of reservation to persons with disability who acquire disability after entering into Govt. service..
The undersigned is directed to say that various Ministries/Departments have been seeking clarification whether a person who acquires disability after entering into Government service shall get the benefit of reservation in services as provided in this Department's OM No.36035/3/2004-Estt.(Res.) dated 29.12.2005.2. It is hereby clarified that the OM dated 29.12.2005 does not make any distinction between persons acquiring disability before or after entering into service. An employee who acquires disability after entering into service will be entitled to get the benefit of reservation as a person with disability as provided in the instructions contained in the above referred OM from the date he produces a valid certificate of disability.3. All Ministries/Departments etc. are requested to bring it to the notice of all establishments under their control.

PAY RELEIF FOR GOVT OFFICERS ON DEPUTATION IN PSUs

Government officers on deputation as executives in public sector undertakings (PSUs) can heave a sigh of relief. After a series of representations from administrative ministries, the department of public enterprises (DPE) has tweaked pay commission recommendations for government officers serving as executives on deputation in PSUs.
The Pay Revision guidelines issued in November 2008 barred such officers on deputation from taking PSU grade salaries and perks. However, a new order issued recently, reverses the guideline to the extent that it will not apply with retrospective effect. This means that government officers appointed on deputation to PSUs before the Pay Commission Recommendations notification came into force on November 26, 2008 will continue to draw their existing salaries and perks till the end of their tenure. However, officers appointed on deputation to PSUs after 26.11.2008 will not be eligible for the salaries and perks of the PSU they are with.
“A number of administrative ministries including the Railways had representations to the department of public enterprises over this issue. Ministries had said that there were difficulties in implementing these with retrospective effect as not all perks can be exactly valued,” a senior DPE official told The Indian Express. The DPE had set up an anomalies committee to address the issues. The new memorandum has been issued after taking their views.
In addition to this, board level officers appointed by the PSUs on recommendations of the Public Enterprises Selection Board (PESB), will also be allowed to continue with the Industrial Dearness Allowance (IDA) pay scale. IDA is linked to the performance of the PSU and is enhanced if the company does well.

Subject:- Recommendation of 6th Central Pay Commission - Grant of Annual Allowance at the revised rates to Central Health Service officers.

The issue regarding revision of rates of Annual Allowance admissible to Central Health Service officers has been under consideration of the Government of India. -2. Consequent upon the acceptance of 6th central Pay Commission's Report, the President is pleased to decide that hereafter the officers of Teaching, Non-Teaching, Public Health sub-cadres and General Duty Medical officers having PG qualification recognized under Indian Medical Council Act, 1956 will be granted Annual allowance at the rate of Rs.1000 P.m.(Rupees one Thousand per month). The General Duty Medical officers who do not possess any post graduate qualification or who may possess unrecognized PG qualification will be granted Annual allowance at the rate of Rs.600 p.m. (Rupees Six Hundred per month). These revised rates of Annual allowance will be subject to the following conditions: 'At the end of the financial year, each Specialist / General Duty Medical Officers will be required to furnish a certificate to the effect that the amount of Annual Allowance has been utilized for the purpose it was drawn. In the case of retirement / resignation before the end of the financial year, such a certificate will be furnished at the time of such retirement / resignation.'3.The rates of these allowances will be increased by 25% every time the Dearness Allowance payable on revised pay scale goes up by 50%.4. This order will take effect from 1.9.2008.5. This issues with the concurrence of Ministry of Finance, (Department of Expenditure) vide their I.D. No.83/E.IV/2009 dated: 24.03.2009.

CGHS SUBSCRIPTION RATES REVISED

The Rates of subscription under CGHS has been revised by concerned authorities of Ministry Of Health and Family Welfare and issued an order on 20th May 2009.
The reason cited in the order for this hike in the subscription is The upward revision of pay/ pension of doctors and other staff in the CGHS has increased the cost of operating the Central Government Health Scheme. It has, therefore, been decided to revise the rates of subscriptions, to be made by employees / pensioners, for availing benefits under CGHS, with effect from 1st June 2009 . It has also been decided to revise the monetary ceiling limits for various entitlements of the beneficiaries for availing CGHS facilities.

BANK OFFICERS FEDERATION WANTS 30% INCREASE IN SALARIES

All India State Bank Officers Federation has said merger and consolidation of public sector banks would harm the banking activities in the country and nullify the financial inclusion concept of the Government itself.
The federation also pressed for a 30 per cent increase in salaries of bank officers, saying that a 15 per cent increase that is being offered is not enough.
The officers also want one more pension option and are prepared to contribute up to Rs 1,800 crore of the Rs 6,000- crore additional fund needed for the purpose, federation general secretary G D Nadaf said at a press conference here yesterday.
TN Goel, President of the Federation, said the earlier salary agreement with the Indian Banks Association had expired on October 31, 2007, and a new one was due on November 1, 2007. All the four bank officers' organisations had submitted a common charter of demands to the IBA and the Government on October 29, 2007, but nothing had been done in the matter of revision so far. The officers organisations would not agree to anything less than 30 per cent increase in salary, he said.

AIFUCTO ON UGC PAY REVISION FITMENT TABLE

AIFUCTO President Prof. Thomas Joseph and General Secretary Prof. Asok Barman have welcomed the issue of the pay revision fitment table by MHRD,Govt. of India and expressed their strong reservations against the provision of the fitment table which is at variance with the notification of MHRD dated 31-12-2008. The fitment table order has denied one bunching benefit to all teachers in selection grade/reader designation. AIFUCTO has demanded that the anomaly be corrected immediately, failing which AIFUCTO will be compelled to respond by direct action.
AIFUCTO also demanded that all state governments immediately implement the new pay scales in accordance with the MHRD notification dated 31-12-2008. The leaders pointed out that the scales have already been implemented in central universities and that state level implementation is already long overdue .AIFUCTO warned that the teachers would resort to agitational action if there is any further delay in the implementation of scales in the states.
The National Executive Committee of AIFUCTO which is scheduled to meet at Shillong on 6.6.2009 will review the status of implementation and decide on the appropriate form of action to be resorted to at the central and state levels for the rectification of anomalies and implementation of the scales.

UGC Pay Hike New Fitment Table
The Ministry of HRD has finally come up with the release of Official Fitment table for pay of teachers and equivalent cadres in Universities and colleges and also for the post of Registrars/Deputy Registrars.The fitment table was a long standing demand for the fixation of pay and allowances for the existing incumbents , who were in position as on 01.01.2006 in various categories of posts.

Holidays to be observed in Central Government Offices during the
year 2010.
It has been decided that the holidays as specified in the Annexure -I to this O.M. will be observed in all the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2010. In addition, each employee will also be allowed to avail himself/herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure - II.
2. Central Government Administrative Offices located outside Delhi / New
Delhi shall observe the following holidays compulsorily in addition to three
holidays as per para 3.1 below:

2. INDEPENDENCE DAY
3. MAHATMA GANDHI'S BIRTHDAY
4. BUDHA PURNIMA
5. CHRISTMAS DAY

3.1. In addition to the above 14 Compulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Central Government Employees Welfare Coordination Committee in the State Capitals, if necessary, in consultation with Coordination Committees at other places in the State. The final list applicable uniformly to all Central Government offices within the concernedState shall be notified after seeking prior approval of this Ministry and no change can be carried out thereafter. It is also clarified that no change is permissible inregard to festivals and dates as indicated.

3.2 No substitute holiday should be allowed if any of the festival holidays
initially declared subsequently happens to fall on a weekly off or any other nonworking day or in the event of more than one festivals falling on the same day.
4. The list of Restricted Holidays appended to this O.M. is meant for Central
Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.
5.1 For offices in Delhi / New Delhi, any change in the date of holidays in
respect of Idu'l Fitr, Idu1 Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.
5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idu1 Fitr, Idu1 Zuha, Muharram and Id-e-Milad.
5.3 It may happen that the change of date of the above occasions has to be
declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.
6. During 2010, Diwali (Deepavali) falls on Friday, November 5, 2010 (Kartika'14). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on "Narakachaturdasi Day". In view of this, there is no objection if holiday on account of Deepavali is observed on "Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government. However, in the year 2010, Diwali (Deepavali) and Narak Chaturdasi Day, both are falling on the same day i.e. November 5,2010.
7. Central Government Organisations which include industrial, commercial
and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi's birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2010, subject to para 3.2 above.
8. Union Territory Administrations shall decide the list of holidays in terms ofMinistry of Home Affairs letter No.14046/27 /83- GP-I dated 15.2.1984 by which they would observe a total of 16 holidays including the three National Holidays Viz. Republic Day, Independence Day & Mahatma Gandhi's birthday.
9. In respect of Indian Missions abroad, the number of holidays may be
notified in accordance with the instructions contained in this Department's O.M.No.12/5/2002-JCA dated 17th December, 2002. In other words, they will have the option to select 11(Eleven) holidays of their own only after including in the list, three National Holidays and Milad-Un-Nabi or Id-E-Milad, Mahavir Jayanti, Idu'l Fitr, Dussehra (Vijaya Dashami), Guru Nanak's Birthday, Christmas Day included in the list of compulsory holidays and falling on days of weekly off.
10. In respect of Banks, the holidays are restricted to 15 days in a year in terms of the instructions issued by the Department of Economic Affairs (Banking devision).

ENCASHMENT OF EARNED LEAVE ALONG WITH LTC

Subject:-Encashment of earned leave alongwith Leave Travel Concession while in service.

The undersigned is directed to refer to Rule 38-Aof CCS(leave) Rules, 1972 regarding encashment of earned leave alongwith LTC while in service which says that Government servants are permitted to encash earned leave upto 10 days at the time of availing Leave Travel
Concession subject to the condition that earned leave of at least an equivalent duration is also availed of by the Government servant simultaneously. This Department has been receiving a number of references from various Ministries/Departments to waive this condition
citing practical problems faced by them as the facility of LTC is also admissible while availing Casual Leave.
2. The matter has been examined in this Department in consultation with the Ministry of Finance and it has now been decided to permit Government servants encashment of earned leave upto 10. days at the time of availing LTC without any linkage to the number of
days and the nature of leave availed while proceeding on LTC.
3. These orders shall take effect from the date of issue.
4. Formal amendment to the provisions of CCS(Leave) Rules, 1972 are being issued separately.
